<p>まずは対人信頼(interpersonal trust)について。</p>

<p>つまり「◯◯さんは人として信頼できる」というのが対人信頼なわけだ。
それに対し,社会的信頼(social trust)については</p>

たとえば企業が「顧客サービスは信頼が大事」などというときの「信頼」は対人信頼ではなく社会的信頼ということだ。

<p>このエッセイを読みながら5年前に書いた記事を思い出してた。</p>

喩えるなら百貨店の外商がリアルタイムで店と連携をとりつつ24時間家の中に張り付いているようなものだ。
「外商」が忠誠を誓うのは所属する店であり,客との関係は利害の一致を基本とした信頼関係に過ぎない。
これが「執事」なら向きが逆になる。
「執事」は主人に忠誠を誓うからこそ執事として機能するし主人は執事をコントロールできる。</blockquote>

<p>そうそう。
関係ないが <del>「地上最大のロボット」</del> じゃない「PLUTO」のアニメ版が Netflix で公開されているらしい。
当時コミックをあれほど<a href="https://baldanders.info/spiegel/log/200605.html#d07_t2">絶賛した</a>のに,アニメはまだ観てないとか。
平日はアニメを観る気がしなくて,週末はチャリンコを乗り回して遊んでるので,やっぱりアニメは観なくなった。
このまま年を越してしまうのか…</p>

<p>件のエッセイは米国を念頭に書かれているが,当然ながら AI を通じた「搾取」は全世界(の人々)に及んでいる。
一国の問題ではないのだ。</p>
<p>このアイデアはシンプルで面白いと思うが,実現するためにはかなり綿密な制度設計が必要だろうし,本当に実現可能かどうかも分からない。
でも AI を通じた「搾取」は存在し,何らかの形でそれを再配分する仕組みが必要,というのはみんな考えるところだろう。</p>
<p>最後にエッセイでは</p>

Generative AI を拒否・否定するのではなく,この技術が sustainable かつ(まさに) generative に発展するための制度設計が必要だ,ということであろう。</p>

最初に挙げた記事を参考に見ていこう。</p>

<p>前者の「既存著作物との同一性・類似性」について、AIは関係ありません。これまでの膨大な判例を元に、判断基準がほぼ確立しています。</p>
<p><strong>たとえ「作風・画風」が類似していたとしても、「同一性・類似性」があることにはなりません。これは文化庁の資料に記載されているとおりです。</strong></p>

これについて件の記事では以下のように示している。</p>

<p>つまり生成物を公表する際,著作権侵害にあたるかどうかを判断するために上の3つの情報開示を要求される可能性があるということだ。
そして,この要求に応えられないサービスは copyright-safe とは言えないのではないかと思う。
また,利用者は生成時のプロンプトが(おそらくサービスプロバイダ経由で)開示される可能性を考慮する必要がある。</p>

<p>話が横滑りしてスマン。</p>
<p>上で出てきた「享受」という法律用語は<a href="https://elaws.e-gov.go.jp/document?lawid=345AC0000000048" title="著作権法 | e-Gov法令検索">著作権法</a>の「著作権の制限」に出てくる。
たとえば第三十条の四は「著作物に表現された思想又は感情の享受を目的としない利用」について書かれている。</p>

前節の記事に出てくる「享受」を脳内で enjoy と読み直せばもう少し分かりやすくなるかもしれない(笑)</p>

4月1日と明記されてたのでエイプリルフールを疑ったが,マジな記事なようだ(笑)</p>
<p>これによると Flickr のガイドラインに以下の文言が追加された。</p>

<p>とか書かれていて,あまりの納得感に思わず笑ってしまったのだが,「ビジネス顧客にとって良き存在になるために、ユーザを虐げる」をプラットフォームの第2フェーズとするなら, Flickr はこのフェーズへの移行をどうにか踏み留まっている状況か。
末永く踏み留まっていただきたいものである。</p>
<p>まぁ,なんちうか「文化の発展に寄与する」ってのは,こういう活動を指すんだよね,本来は! どこぞの文化庁やら文科省やら,あるいは某 Twitter とかに於いては,よくよく考えていただきたい。</p>

<p>前著の『<a href="https://www.amazon.co.jp/dp/4903127044?tag=baldandersinf-22&linkCode=ogi&th=1&psc=1">排除型社会</a>』と併せ,これらの本ではインターネットの「イ」の字も出ないのが特徴だが(だからお気に入りなのだ),件の記事を読むに,リアルな「過食症的な社会」と似たような現象がインターネットでも社会現象として起こっているというのが面白い。
ネットに於いても,多様化が云々といいつつ,やってることは「過剰包摂」に過ぎないわけだ。</p>
<p>これは「脱中央集権」アーキテクチャでも同じ。
特にモノリシックな「脱中央集権」アーキテクチャは「過剰包摂」に陥りやすいだろう。</p>
<p>最初に挙げた記事でもうひとつ連想したのは Danah Boyd による『<a href="https://www.amazon.co.jp/dp/B0125TZSZ0?tag=baldandersinf-22&linkCode=ogi&th=1&psc=1">つながりっぱなしの日常を生きる</a>』だ。</p>

<p>原題の “It’s Complicated” のとおり,この本の内容は多岐に渡っていてなかなか<a href="https://text.baldanders.info/remark/2016/05/its-complicated/" title="『つながりっぱなしの日常を生きる』を読む">読むのが難しかった</a>のだが,テーマのひとつに10代の子供のネットにおける生態がある。
その前提として,大人の包摂された社会から見て子供もしくは子供コミュニティは排除ないし周辺化されているという事情がある。
そこで子供らはネットを避難先とするのだが,調査期間であるゼロ年代後半から2010年代はじめ頃はまさに SNS による「過剰包摂」が進行(侵攻?)しつつあるときであり,そういった状況でどうやって自身のアイデンティティを保つか苦心している様子が描写されている。</p>
<p>結局のところ,技術がどう進歩しようと,それによって社会の「盤面」がどう変わろうと,その上で踊る私達は何も変わらず同じことを繰り返す。
…ということを改めて確認する話であった。</p>

もうちょっと簡単に言うと「英雄は裁かれない」ってやつだ。</p>

<p>という tweet を起点に考察したものだ。
とはいえ,この tweet 自体は個人的には納得できる。
むしろ Twitter 側が計測もせずに主観でタイムラインを弄ってた,なんて話だったら,そっちのほうが拙い。</p>

<p>をクリックすれば「ホーム」と「最新ツイート」を切り換えることができる<sup id="fnref:1"><a href="#fn:1" class="footnote-ref" role="doc-noteref">1</a></sup>。
しかも永続的に効く。
Facebook も「最新」にできるけど永続的に効かないので,画面を開くたびに切り換えないといけないんだよなぁ。
Instagram はアカウントを捨てたし TikTok はそもそもアカウントを取ってないので知らない(笑)</p>
<p>Twitter にとって主たる「顧客」は株主<sup id="fnref:2"><a href="#fn:2" class="footnote-ref" role="doc-noteref">2</a></sup> と広告主だ。
さんざん言われていることだが,ユーザは「商品」でしかない。
商品を陳列棚(=タイムライン)にどう並べらたら利益が上がるか計測(=監視)するのは営利企業として正しいし,計測結果に従って商品を並べ替え,さらに法を根拠に取り下げる(=検閲)のも正しい。
フォローもしてない広告アカウントが頻繁にプロモーションツイートを差し込むのも正しいわけだ。
忌々しいことに。</p>
<p>このことから分かるように,覇権プラットフォームに於いて私達は「量」として評価され,ひと括りの「ユーザ」として包摂されている。
ユーザを個人として見ているわけではないから個人に対する公正さは考慮されない。
そして「Twitter の正義」からこぼれ落ちる個人は排除される。</p>
<p>包摂と排除はコインの表裏の関係である。
排除されていることに我慢ができないのなら,排除されない別の包摂基準を持つプラットフォームへ移住するか,さもなくば自身がプラットフォーマー<sup id="fnref:3"><a href="#fn:3" class="footnote-ref" role="doc-noteref">3</a></sup>(笑)になるか。
国際移民問題と同根だな,これ。
何故か日本では「クレームをつければ黒いカラスも白くなる」と思ってる人が多そうな印象だが。</p>
<p>私自身 Twitter は「広告媒体」であると認識しており,情報収集の手段として重宝してはいるものの,仮に某マスク氏が突然「もう閉店ガラガラ」とか言ってシャットダウンしたとしても全く困らない。
そこまではなくても Twitter の独裁化が進むであろうことは容易に想像できるし,そうなればその「孤独な正義」からこぼれ落ちる個人は(私も含め)増えるかもしれない。</p>

社会が「多様性(diversity)」を重視しつつある昨今,プラットフォーム覇権主義はもはや無理筋と言えるだろう。
そこで私達にできることは,陳腐ではあるが,覇権プラットフォームにロックインされないことである。
『<a href="https://www.amazon.co.jp/dp/B07FSBHS2V?tag=baldandersinf-22&linkCode=ogi&th=1&psc=1">Clean Architecture</a>』的に言うなら「プラットフォームは詳細である」といったところか(笑)</p>

ある「表現」が公有になるまで(70年!)待ってたら消失して何処にも見当たらない,なんてなこともありうる話だ。</p>
<p>今年に入ってからも TechCrunch Japan 終了の際に,それまでの日本語記事を(翻訳記事以外も含めて)<a href="https://text.baldanders.info/remark/2022/02/the-nation-of-amnesia/" title="記憶喪失の国">あっさり捨て去った</a>ことなど,まだ記憶に新しいだろう。
これに比べれば,<a href="https://yamdas.hatenablog.com/entry/20221128/cakes_data_journalism" title="cakesに掲載された「ネット×ジャーナリズムの歴史とその最新潮流としてのデータジャーナリズム」をサルベージした - YAMDAS現更新履歴">公開が終了した記事を著者に渡して後を委ねた cakes</a> とか良心的なほうである。</p>
<p>あるいは,どこぞの GitHub みたいに<a href="https://text.baldanders.info/remark/2020/07/github-archive-program-2020/" title="私的コード黒歴史が北極に千年封印される">北極に千年封印する</a>なんてな手もあるかもしれない。
でも,それって封印が解かれるまで照会も再利用もできないってことだよね。
常に変容するプログラム・コードのある時点を封印することに,どれほどの意味があるか知らんけど。</p>
<p>デジタルな「表現」が,倫理・道徳・法・政治・市場・社会構造を超えて常に「使用」または「利用」できる状態を維持しつつ(100年単位で)保持し続けるというのは,かなり大変であろうことは想像に難くない。</p>
<p>とりあえず <a href="https://www.flickr.org/" title="The Flickr Foundation">Flickr Foundation</a> は2023年までの3年計画で色々と準備をするみたいなので,それらを注視するところから始めますかね。

更に2018年以降 Misskey, Pleroma, Pixelfed といったあたりが対応をはじめた。
更に更に,昨今の「Twitter お家騒動」を受けて Tumblr が <a href="https://www.w3.org/TR/activitypub/">ActivityPub</a> に対応すると表明し,我らが Flickr も検討に入ったらしい。</p>

<p>Fediverse とは federation と universe を組み合わせた造語だそうな。
たとえば Mastodon はそれ自体が連合(federation)型の分散システムだが,そうしたサービス同士が更に緩くフラットに結びついた状態を指すらしい。</p>

<p>これら連合型システムを結びつける技術要素のひとつが <a href="https://www.w3.org/TR/activitypub/">ActivityPub</a> というわけだ。
ぶっちゃけ,どこぞの FinTech 山師が叫ぶ Web3 より,こっちのほうがよほど次期 Web ぽいよな(笑)</p>
<p>EFF の解説記事では従来の Facebook や Twitter といったサービスを「プラットフォーム」あるいは「中央集権」型に分類し Fediverse と対置しているのが面白い。
Mastodon 等は単なる「代替サービス」ではないということだ。</p>

<blockquote><p>連合には中央機関が存在しないため、Twitter独自の認証バッジなどの複数の機能はまったく意味をなさない。「認証(verified)」に近いものとしては、自分のプロフィールに特定のハイパーリンクを掲載し、外部のウェブページやリソースを管理していることをインスタンスに証明するというものがある。</p>
<p>fediverseは分散型であるため、投稿を管理したり、アカウントを削除する単一の権限はなく、すべてはユーザとサーバに委ねられている。Mastodonのユーザは一般に、投稿にコンテンツ警告マークをつけている。これは本当にセンシティブなコンテンツ(たとえば、戦争のニュースに関するコンテンツ警告)のためだけではなく、タイムライン上の投稿の足跡を最小化するためにも用いられている。また、ハッシュタグと合わせて、センシティブではない投稿の分類やキュレーションにも用いられている(たとえば、コンテンツ警告:「うちの猫 #pets」)。</p>

<p>こうしたプラットフォーム型サービスに対する失望感(絶望感?)が今回の「Twitter お家騒動」より派生する諸々の出来事の背景にあるのかもしれない。
そして最後に EFF はこう断ずるのである。</p>

<p>最後の「反競争的行為の阻止」「ポータビリティ」「委任可能性」3つは “<a href="https://en.wikipedia.org/wiki/Embrace,_extend,_and_extinguish">Embrace, Extend, and Extinguish" (EEE)</a>” のカウンタかな。
つか「取り込み、拡張し、抹殺する」とか物騒なフレーズがあるんだな(笑)</p>
<h2>「プラットフォームとフェデレーションとの競争」</h2>
<p>コンピュータおよびコンピュータ・システムの歴史は集中と分散の繰り返しである。
ネットも同じ。
プラットフォーム間の覇権争いに巻き込まれてウンザリしたユーザが緩い連合型システムに流れるのも自然なことのように思える。</p>
<p>しかし,これまで見たように Mastodon は Twitter の代替にはなりそうもない。
Twitter から Mastodon に逃げたユーザが,自分たちの「Twitter 文化」を振りかざして迷惑をまき散らしているという話もちょいちょい聞く<sup id="fnref:1"><a href="#fn:1" class="footnote-ref" role="doc-noteref">1</a></sup>。
リアルの「移民問題」と似たような話がネットでも出てくるというのは興味深い。</p>
<p>Fediverse が「素晴らしいもの」になるか否かが「“私たち”次第」ということは,言い方を変えれば Fediverse は属人性の強い壊れやすいシステムであるということだ。</p>
<p>EFF の解説記事はこう締めくくる。</p>

<p>「文化とは文化の<ruby><rb>混血児</rb><rp> (</rp><rt>hybrid</rt><rp>) </rp></ruby>」である。
作られた monolithic な文化は簡単に腐る。
今回の騒動が新たな風を呼び込み generativity に満ちた社会に発展することを期待したい。</p>

<p>まず大前提として,そもそも著作権というのは他者の「表現」を規制することを意図し「作られた権利」であるということ,さらに「表現」と「意匠」は各種知財権の観点では異なるドメインであることは頭に入れておいて欲しい。</p>
<p>もうひとつの前提として,アウトプットする機械に「権利」は発生しない。</p>

<blockquote><p>もう1つの論点が「AI生成物は著作物なのか?」である。著作物であれば、作成者がAIであっても第三者は勝手に利用できない。仮に著作物であるとすると、自動作曲サービスで作成された楽曲の第三者による利用や流通は大幅に制限される。</p>
<p>これに対する国際的な通説は「人がコンピューターを道具として使えば著作物」。ただ、創作の主体はあくまで人でなければならない。これは、人がカメラ(という道具)を使って撮影した作品を著作物として扱う考えと近い。逆に、人が主体とならず、ボタン1個で生成されるような楽曲は、著作物ではないとされてきた。</p>

<p>「権利」というのは「(法的な意味での)人」に対して発生するものであり,機械は「人」と認められていない。
ゆえに機械がアウトプットする「著作物」の権利はインプットする(それが著作物なら)著作物の権利者とアウトプットさせる人との関係で発生する,ということになる。</p>
<p>たとえば美術館に飾ってある絵画をカメラで撮ったら,その写真の権利は絵画の著作(権)者に帰属する(逐次的コピーというやつだ)。
一方,絵画の著作権が期限切れなら写真を撮った人に権利が帰属するかもしれない。</p>
<p>その上で「〇〇風のデザイン」というときに,それが「〇〇」の翻案と言えるのか,それとも(「表現」ではなく)「意匠」という別ドメインの問題なのか,あるいは全然まったく無問題なのか,といった議論はあっていいと思う。
ちなみに,日本の著作権法に「公正な利用(fair use)」という考え方はないし「権利の制限」は使いどころも制限されている。</p>
<p>まぁ,実際には(問題・実害があるなら)何らかの訴訟を起こして司法の判断を仰ぐべきだろうけど。
自称専門家の戯言や官僚のご都合主義なガイドラインや<a href="https://text.baldanders.info/remark/2022/08/bad-copyright/" title="DRM 制限されているメディアから銭を巻き上げようとする文化庁">合理性に欠く政令</a>に振り回されるべきではない(本来なら)。</p>
<h2>AI を巡る情報の非対称性</h2>
<p>以前の「<a href="https://text.baldanders.info/remark/2022/07/code-launderring/">GitHub Copilot は貢献者から貢献を奪うか?</a>」でも少し書いたが, Copilot の問題は学習データのインプットが不透明な点にあると思う。
AI という機械を挟んで情報が非対称になっているわけだ。
コードを AI にぶち込むことで,付随するライセンスやコード貢献<sup id="fnref:1"><a href="#fn:1" class="footnote-ref" role="doc-noteref">1</a></sup> といった諸々が「洗浄」されてしまう。</p>
<p>でもこれはプログラム・コードに限った話ではないし,文章や映像・絵画・イラストや音楽などは関係するアクターが分かりやすいので余計に面倒くさくなる。</p>
<p>出自が不透明な「AI 作品」は,喩えが悪くて申し訳ないが,よく分からない食材で作られた料理みたいなものだ。
個人では食材など気にせず美味ければ食うという人もいるだろうし「無理!」という人もいるだろう。
でも食材の traceability が重視される昨今に於いて「よく分からない食材で作られた料理」というのは社会的には NG だと思う。</p>
<p>「AI 作品」もそろそろそういうフェーズに入ったのではないか,と私は思うのだがどうだろう。
餓鬼のごとく何でも食わせて「AI ならこんなこともできます」とかいった物言いは通用しなくなってくると思う。</p>

<p>結局そこだよなぁ。
なりすましとか絵柄パクとか言い募るほど「要するに『AIに仕事やアイデンティティが奪われる』ことへの恐怖だろう」という感想にしかならない。
まぁ,軽い話ではないが時代の転換点ではよくある話でもある。</p>
<h2>「機械学習技術の民主化」</h2>

まぁ,悪意や害意を持つ人ならわざわざ mimic のようなサービスを使わなくても自家発電できるよね。</p>
<p>そう考えると <a href="https://kai-you.net/article/84595" title="画風を学ぶAIイラストメーカー「mimic」が物議 他人の絵を学習させる悪用を懸念 - KAI-YOU.net">mimic のような事例</a> は,学習データのインプットを(サービスではなく)ユーザがコントロールでき,かつそれを他者(サービス?)が監視可能という点でまだマシという気がする。
あとは系(システム)全体の透明度をどの程度上げれるかだろう。
透明度を上げていけば周囲が懸念する「絵柄パク」のようなケースも自然に析出される筈。</p>
<p>でも,こういうのは「文化」が重要なんだよね。
サービスやコミュニティ内で「パクリ上等」みたいな雰囲気が醸成されてしまうと本当にカオスになるし,「パクリ,ダメ,絶対」みたいな規範が育つと(良くも悪くも)同調圧力がかかったりする。</p>
<p>何度でも言うけど,社会を変えるのはそれを構成する「人」なのよ。
AI お絵描きの明日はどっちだ(笑)</p>

<h2>「工学は善の実現」</h2>
<p>リスクだけを論って dis ったり禁止しようとするのは野蛮人の所業だ。
かといってベネフィットだけを見てリスクに目を向けないのはお馬鹿だろう。
道具・手段は上手に使ってこそである。
そして「上手に使う」ことを助けるための実装を行うのがエンジニアの仕事である。</p>
